Agreement to terms

These Terms of Use are entered by and between You and Ganjingworld Corporation (“Company,” “we” or “us.”). The following terms and conditions together with any documents they expressly incorporate by reference, “Terms of Use” govern your access to and use of the Gan Jing Browser (the “Browser”), including any content, functionality, services offered on or through the Browser. “Services” refer to the services provided by the Gan Jing Browser. “You” refers to the individual accessing or using the Browser or contacting the Company.

These Terms of Use constitute a legally binding agreement entered by You and the Company concerning your access to and use of our Services. This Browser is offered and available to users who are18 years of age or older. By using this Browser, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all the foregoing eligibility requirements or have parental consent to do so. We grant You a revocable, non-exclusive, non- transferable, limited license to download, install and use the Application strictly in accordance with the terms of this Agreement.

The license that is granted to You by the Company is solely for your personal, non-commercial use strictly in accordance with the terms of this Agreement

Modifying the Browser

The company reserves the right to change, modify, or remove the content of our Services at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of our Services without notice at any time. You agree that we have no liability to you or any third party whatsoever for any loss, damage, or inconvenience caused by your inability to access or use our Services during any downtime or discontinuance of our Services.

  • Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other harmful material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interfere with any party’s uninterrupted use and enjoyment of our Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of our Services.
  • Make improper use of our support services or submit false reports of abuse or misconduct.
  • Interfere with, disrupt, or create an undue burden on our Services or the networks or services connected to our Services.
  • Harass, annoy, intimidate, or threaten any of our employees, agents or affiliates engaged in providing any portion of our Services to you.

We reserve all rights not expressly granted to you regarding the Services, the Content and the Marks.

WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR THE ACCURACY OR RELIABILITY OF ANY INFORMATION OFFERED BY THIRD-PARTY WEBSITES LINKED THROUGH THE SERVICES. WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.

The browser additionally offers you the opportunity to download a directory of open-source lists enabling you to block unwanted ads and to protect your privacy. If you grant permission, the browser will download those lists to protect you.

Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of our services; (2) breach of these Terms of Use; (3) any breach of your representations and warranties set forth in these Terms of Use; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; (5) any overt harmful act toward any other user of our services with whom you connected via the services; or (6) any applicable law, contract, or other obligation. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

Termination

These Terms of Use shall remain in full force and effect while you use our services. Without limiting any other provision of these Terms of Use, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of our services, to any person for any reason or for no reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms of Use or of any applicable law or regulation. Upon any termination, relevant provisions including, but not limited to, the disclaimer, the limitations of liability, and indemnification shall survive termination.

Governing law

These Terms are governed by the laws of the state of New York, excluding its conflict of law provisions. If any provision of these Terms of Use is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Miscellaneous

You may not rent, lease, lend, sell, redistribute, or sublicense our Services. The Terms of Use are not assignable or transferable by you except with our prior written consent. We may assign, transfer or delegate any of the rights and obligations listen in these Terms of Use without consent.
